UMA ABORDAGEM SOBRE O ESTATUTO DA CRIANÇA E DO ADOLESCENTE SOB A PERSPECTIVA EDUCACIONAL E SOCIAL

Abstract

Considering that the study and research on public policies within the scope of the Statute of the Child and Adolescent are necessary to provide an understanding of where, how and why these investments are applied in the public agencies that provide care services to the families that resort to them, this research on the Statute of the Child and Adolescent is carried out from an educational and social perspective in order to verify how the Statute of the Child and Adolescent works as a public policy and as a Law for the defense of the rights of children and adolescents. To do so, it is necessary to study the Statute of the Child and Adolescent as a Law for the protection of childhood and youth, as well as the other constituent elements of this Law. Verify how the ECA manifests itself in the execution and implementation of public policies. To compare legislation before and after the ECA. This is a research with an analytical, descriptive, qualitative, and bibliographical approach. In view of this, it can be seen that the ECA was indeed decisive in the formulation of assistance policies aimed at the specificities of this public. That what guides the creation of this Law is a history of violation of the rights of this public by society, but mainly by the State. That the Statute has been improving and tightening its provisions in order to better protect its population under the age of 18. Although we have advanced in the integral protection of children and adolescents, there is still a long way to go. The 32 years of the statute brought the ideal to be pursued so that better services are offered to this public, and we verify that the State still needs to make effective what the law guarantees.
